This paper examines the 'taking back control' over immigration arguments offered for Brexit and for reinforcing the Southern border of the United States. According to these arguments, Brexit and increased border enforcement were needed to ensure collective self-governance for the peoples of Britain and the United States. I argue that 1. In fact these policies did little to enhance collective self-governance properly understood, and 2. They actually thwarted collective self-governance due their racially exclusionary effects on people of color in Britain (...) and the United States. (shrink)

This paper presents a novel framework for evaluating racial profiling, including 'rational profiling' that does in fact decrease crime rates. It argues that while profiling some groups, such as African Americans and Muslims, is impermissible, profiling others, such as white men, may be permissible. The historical and sociological context matters significantly. Along the way, the paper develops a new theory of what expressive harms are, why they matter, and when it is the responsibility of the state to correct them.

The role of responsibility in our common-sense morality of self-defense is complex. According to common-sense morality, one can sometimes use substantial, even deadly, force against people who are only minimally responsible for posing a threat to us. The role of responsibility in self-defense is thus limited. However, responsibility is still sometimes relevant. It sometime affects how much force you can use against a threatener: less if they are less responsible and more if they are more responsible. Is there a well-motivated (...) theory that can explain both why the role of responsibility is limited and why it is sometimes relevant? It is hard to see what theory could unify these disparate elements of our common-sense morality, and if one cannot be found then we may simply have to revise some of our pre-theoretic beliefs. But it would be an important advantage of a theory if it could justify those beliefs. I will argue that there is a theory of this kind: surprisingly, the familiar rights theory of self-defense, defended by Judith Thomson, can do so if it is suitably supplemented. Along the way I will survey some alternative theories of self-defense and show why they are not up to the task. (shrink)

The attempt is made in this article to analyze and compare the religious policies of the two Safavid and Qajar dynasties’ governments with respect to Sunnite sect. In these eras the related policies differed although the official religion of both regimes was Shiism: The Safavid central government’s confronting policies against Sunnite, the Sunnite elites’ long-term appointments to high state ranks by Qajar Kings and these policies were more consistent in Qajar than Safavid era. Here the approaches of both the dynasties (...) are categorized in four parameters: confronting, excommunication, discrimination and moderation. Background:The decision-making process should be done according to a set of rules and principles so as to be fairly understood.Objectives:The aim of this study was to identify the basic principles and rules used by nurses to understand justice in nurse managers’ decision-making processes based on a procedural justice model.Research design and participants:This research was a qualitative study based on directed content analysis, which was performed on a group of 15 nurses working in different hospitals in Tehran, Iran. An in-depth semi-structured (...) interview was used as the method of data collection for this study.Ethical consideration:This research has been approved by the Ethics Committee of the University of Social Welfare and Rehabilitation Sciences. The respondents were informed about the aim of the study, about voluntary participation, anonymity and confidentiality.Findings:The results of this study showed that in order to understand procedural justice, nurses use several rules, including: duties organization, managerial support, consistency, bias-suppression, accuracy, correctability, representativeness, and ethicality.Conclusion:Nursing leaders must consider the importance of justice rules as one of many strategies to ensure the nurses’ perception of fairness in decision-making processes. Inspired by Williamson’s knowledge-first epistemology, I propose a position on practical knowledge that can be called the ‘know-how-first view’; yet whereas Williamson is one of the pioneers of the new intellectualism about know-how, I employ the know-how-first view to argue against intellectualism and instead develop a know-how-first version of anti-intellectualism. Williamson argues that propositional knowledge is a sui generis unanalyzable mental state that comes first in the epistemic realm; in parallel, I propose that know-how is a sui generis unanalyzable power (...) that comes first in the practical realm. To motivate this suggestion, I put forward two arguments: drawing on dispositionalist ideas, I argue that the practical component of know-how is unanalyzable; based on an investigation of the natures of intentionality and intelligence, I argue that know-how is prior to intentional and intelligent abilities in the order of explanation of agential action. Deploying this know-how-first anti-intellectualism, I then set out know-how-first solutions to two challenging problems for anti-intellectualism: the sufficiency problem and the necessary condition problem. This paper shows how we can plausibly extend the guise of the good thesis in a way that avoids intellectualist challenge, allows animals to be included, and is consistent with the possibility of performing action under the cognition of their badness. The paper also presents some independent arguments for the plausibility of this interpretation of the thesis. To this aim, a teleological conception of practical attitudes as well as a cognitivist account of arational desires is offered.

In recent years, firms have greatly increased the amount of resources allocated to activities classified as Corporate Social Responsibility (CSR). While an increase in CSR expenditure may be consistent with firm value maximization if it is a response to changes in stakeholders' preferences, we argue that a firm's insiders (managers and large blockholders) may seek to overinvest in CSR for their private benefit to the extent that doing so improves their reputations as good global citizens and has a "warm-glow" effect. (...) We test this hypothesis by investigating the relation between firms' CSR ratings and their ownership and capital structures. Employing a unique data set that categorizes the largest 3000 U. S. corporations as either socially responsible (SR) or socially irresponsible (SI), we find that on average, insiders' ownership and leverage are negatively related to the firm's social rating, while institutional ownership is uncorrelated with it. Assuming that higher CSR ratings is associated with higher CSR expenditure level, these results support our hypothesis that insiders induce firms to over-invest in CSR when they bear little of the cost of doing so. In this paper I discuss justice in the distribution of resources, both within states and across different states. On one influential view, it is always unjust for one person to have less than another through no fault of her own. State borders, on this account, have no importance in determining which distributions are just. I show that an alternative approach is needed. I argue that distributions of wealth are only unjust in so far as they issue from unfair treatment. It (...) follows that not all inequalities in the distribution of goods are unjust. I use these results to explain how state borders do play a role in determining which inequalities are unjust, since some of these inequalities issue from unfair treatment of citizens by the state. In this paper I focus on one very influential argument for open borders, the freedom of movement argument, which says that if we value freedom of movement we must demand open borders. I begin the paper the paper by discussing Joseph Carens’ well known version of the argument. I then consider, and reject, David Miller’s response to that argument. Finally, I develop my own reply to Carens. Both Carens and Miller, I argue, are mistaken about the proper grounds for freedom (...) of movement. Once we see this, it is clear how we can value freedom of movement without being committed to open borders. (shrink)

Ptolemy presents only one argument for the eccentricity in his models of the superior planets, while each one of them has two eccentricities: one for center of the uniform motion, the other for the center of the constant distance. To take into account the first eccentricity, he introduces the equant point, but he provides no argument for the eccentricity of the center of the deferent. Why is the second eccentricity different from the first one? The 13 th century astronomer Quṭb (...) al-Dīn al-Shīrāzī, a member of the famous school of Marāgha, who was interested in this problem, suggests the “retrograde arcs” as the empirical origin of the second eccentricity and develops an argument to justify this conjecture. Although his argument is not without difficulty, his suggestion is in line with the suggestions made by some historians of astronomy in recent decades. Résumé Ptolémée ne donne qu'un seul argument pour expliquer dans son système l'excentricité des planètes supérieures, alors que chacune d'elles a deux excentricités: l'une par rapport au centre du mouvement uniforme, l'autre par rapport au centre de la distance constante. Pour rendre compte de la première excentricité, il introduit le point équant, mais il ne donne en revanche aucun argument pour l'excentricité par rapport au centre du cercle déférent. Or, pourquoi la seconde excentricité est-elle différente de la première? In this paper, I discuss some of the criteria that liberal states have used to choose between potential immigrants. While overtly racist policies have been widely condemned and abolished, many states have still in the recent past selected immigrants based on their ethnicity and/or language competency. I argue that even apparently more benign examples of ethnic and linguistic selection are unacceptable because they tend to express a morally problematic message that members of certain ethnic groups within the territory—the people who (...) are really from there— occupy a privileged position within the political community. And this means, I argue, that they unjustly exclude members of other ethnic groups. Finally, I address some special features of linguistic selection that are sometimes thought to make it justifiable, including the de facto inevitability of promoting some languages more than others, the fact that languages can be learned voluntarily, and the fragility of minority languages in territories where there is another language that is more universally known. Using the Stroop paradigm, we have previously shown that a specific suggestion can remove or reduce involuntary conflict and alter information processing in highly suggestible individuals . In the present study, we carefully matched less suggestible individuals to HSIs on a number of factors. We hypothesized that suggestion would influence HSIs more than LSIs and reduce the Stroop effect in the former group. As well, we conducted secondary post hoc analyses to examine negative priming – the apparent disruption of the (...) response to a previously-ignored item. Our present findings indicate that suggestion reduces Stroop effects in HSIs. Secondary analyses show that LSIs had an NP effect at baseline and that suggestion influenced the NP condition. Thus, at least in this experimental context, suggestion seems to dampen a deeply-engrained and largely automatic process – reading – by wielding a larger influence on HSIs relative to comparable LSIs. The doing/allowing distinction plays an important role in our thinking about a number of legal issues, such as the need for criminal process protections, prohibitions on torture, the permissibility of the death penalty and so on. These are areas where, at least initially, there seem to be distinctions between harms that the state inflicts and harms that it merely allows. In this paper I will argue for the importance of the doing/allowing distinction as applied to state action. Sunstein, Holmes, Vermeule (...) and others have presented influential arguments for the claim that where the state is concerned the doing/allowing distinction has no moral significance, even if it does elsewhere. I show that these arguments can be resisted. In doing so, I defend some important distinctions and principles that help us understand the state’s role in protecting people from harm. (shrink)

Recent data indicate that under a specific posthypnotic suggestion to circumvent reading, highly suggestible subjects successfully eliminated the Stroop interference effect. The present study examined whether an optical explanation could account for this finding. Using cyclopentolate hydrochloride eye drops to pharmacologically prevent visual accommodation in all subjects, behavioral Stroop data were collected from six highly hypnotizables and six less suggestibles using an optical setup that guaranteed either sharply focused or blurred vision. The highly suggestibles performed the Stroop task when naturally (...) vigilant, under posthypnotic suggestion not to read, and while visually blurred; the less suggestibles ran naturally vigilant, while looking away, and while visually blurred. Although visual accommodation was precluded for all subjects, posthypnotic suggestion effectively eliminated Stroop interference and was comparable to looking away in controls. These data strengthen the view that Stroop interference is neither robust nor inevitable and support the hypothesis that posthypnotic suggestion may exert a top-down influence on neural processing. The cliché of the clergymen or the religious scholars battling against modern science oversimplifies the history of the encounter between modern science and religion, especially in the case of non-Western societies. Many religious scholars, Muslim and Christian, not only did not oppose modern science but used it instrumentally to propagate their religions. Marwa Elshakry, in her brilliant study of Darwin's opinions among the Arab World, concentrates more on Arab Christians and Sunni Muslims rather than on Shiite Muslims. Muḥammad-Riḍā Iṣfahānī, a (...) Shiite clergyman educated in Islamic theology in Najaf, composed A Critique of Darwin's Philosophy in 1912 as a review of the theory of evolution. However, even before the publication of this book, controversy concerning this topic had been raging in the Arab World for decades. Under the influence of Muslim scholars (Sunni and Shiite) to reconcile modern science with Islam, Iṣfahānī did his best to gather knowledge of modern biology. He applied his self-taught knowledge of modern biology to find new solutions to the difficulties of establishing a dialogue between Islam and modern science. Thanks to the rationalism of his premodern scientific education, Iṣfahānī was more sympathetic towards science than many of his Arab counterparts and able to deeply engage in these debates. Iṣfahānī believed that the theory of evolution in nonhumans did not contradict Islamic discourse nor experimental and rational facts. Nevertheless, he denied the theory of human evolution as a nonscientific hypothesis. He justified his opinion through a detailed refutation of Darwin's heuristic evidence for human evolution in the first chapter of Descent of Man, such as the similarities between anatomy, embryology, and vestigial organs in humans and other animals. He also referred to other Western evolutionists of his time, such as Alfred Russel Wallace and Rudolf Virchow, who also rejected human evolution, and added some other scientific refutations of his own. Undoubtedly, Iṣfahānī's final aim was to demonstrate the possibility of reconciliation between religion in general, and Islam in particular, with modern science. This article provides a detailed consideration of Iṣfahānī's opinions, identifying his Arabic sources and comparing them to the original non-Arabic sources. I also examine the scientific details of Iṣfahānī's achievements and the roots of his misunderstandings. (shrink)

Plagiarism has been on the rise amongst university students in recent decades. This study puts university teachers in the spotlight and investigates their role in raising students’ awareness about plagiarism. To that end, plagiarism policies in 207 Iranian university TEFL teachers’ syllabuses were analyzed. The researchers analyzed the syllabuses to find out if they contain a plagiarism policy, and if so, how the term is defined; whether they approach the issue of plagiarism directly; if they offer students any guidelines on (...) how to avoid plagiarism; and if the consequences of committing plagiarism are specified. The results indicated that the majority of the syllabuses (83.6%) lacked a plagiarism policy and those that did include a policy were often vague in their definition of the phenomenon. However, when there was a plagiarism policy in the syllabuses, the teachers tried to address the issue directly half of the time and offered students brief guidelines on how to avoid plagiaristic behavior, which was a small step in the right direction. It is recommended that other higher education institutions make it obligatory for their academic staff to include a plagiarism policy in their syllabuses if they wish to cultivate academic integrity in students. In this paper I consider the role of freedom in the justification of prohibitions on discrimination. As a case study, I focus mainly on U.S. constitutional and employment law and, in particular, restrictions on sex-stereotyping. I present a new argument that freedom can play at least some important role in justifying these restrictions. Not just any freedom, I claim: the Millian freedom to challenge existing stereotypes and contribute to social change. This ‘social change account’, I argue, can be a useful (...) supplement to the existing theories where their explanations run out. It also draws support from familiar liberal justifications for speech and other liberties, and provides an attractive role for the courts. (shrink)

This study examines an important part of Richard Swinburne’s case for the plausibility of Christianity, namely his Atonement theory. My examination begins by presenting Swinburne’s theory before alluding to the many criticisms it has attracted. I conclude with some lessons which can be learnt about philosophical theology and its use in interreligious dialogue. My main contention is that if philosophical theology is going to be used for inter-religious dialogue, then it should not be used with the expectation that disagreements will (...) be overcome. In this essay, I will try to elaborate the fundamental postulates of transdifferential ontology, developed through the inscription of some basic concepts of poststructuralist philosophy within the realm of general system theory. In this manner, a system/being will be conceptualized as set of elements which is organized as a functional whole, whose goal is not to establish a homeostasis but to menage and organize disruptive forces of lack/surplus, that represents non-mediated kernel of any system. Therefore, any system is fundamentally grounded (...) on imbalance and radical incompleteness as inherent conditions of its possibility. Among different kind of systems, the complex self - organizing systems based on feedback loops are governed by the principle of syntropy and its transdifferential organization of reality. In order to explicate the syntropic movement of systems, the concept of signifier is expanded beyond the boundaries of language, and the process of writing, as a permanent invention of in-vent, is interpreted in the manner of never ending sublation of the system and subversion of the subject. The interconnection between the general system theory and poststructuralist philosophy will provide us with a conceptual apparatus which overcomes both linguistic and entropic limitations of above mentioned domains, in order to conceive, interpret, predict and govern processes of becoming on different levels of organization of systems. Background:Ethical conflict is a barrier to decision-making process and is a problem derived from ethical responsibilities that nurses assume with care. Intensive care unit nurses are potentially exposed to this phenomenon. A deep study of the phenomenon can help prevent and treat it.Objectives:This study was aimed at determining the frequency, degree, level of exposure, and type of ethical conflict among nurses working in the intensive care units.Research design:This was a descriptive cross-sectional research.Participants and research context:In total, 382 nurses working in (...) the intensive care units in Iranian hospitals were selected using the random sampling method. Data were collected using the Ethical Conflict in Nursing Questionnaire-Critical Care Version (Persian version).Ethical considerations:This study was approved by the Medical Research Ethics Committee. Ethical considerations such as completing the informed consent form, ensuring confidentiality of information, and voluntary participation were observed.Findings:The results showed that the average level of exposure to ethical conflict was 164.39 ± 79.06. The most frequent conflict was related to “using resources despite believing in its futility,” with the frequency of at least once a week or a month (68.6%, n = 262). The most conflictive situation was violation of privacy (76.9%, n = 294). However, the level of exposure to ethical conflict according to the theoretical model followed was the situation of “working with incompetent staff.” The most frequently observed type of conflict was moral dilemma.Conclusion:The moderate level of exposure to ethical conflict was consistent with the results of previous studies. However, the frequency, degree, and type of ethical conflict were different compared to the results of other studies. Recognizing ethical conflict among intensive care unit nurses can be useful as it allows to consolidate those measures that favor low levels of ethical conflict, design appropriate strategies to prevent ethical conflicts, and improve the nursing work environment. Este artículo estudia una corta narración en árabe muy conocida a través de diversas versions populares documentadas en manuscritos de diferentes orígenes (Siria, Egipto y Norte de África), comenzando en el siglo XVII. La narración describe cómo un peque.o gorrión queda atrapado en la trampa de un cazador y cómo, mediante todo tipo de estratagemas y usando su ingenio, logra escapar de su terrible destino. Si bien esta narración aparece frecuentemente en los círculos tardíos más populares, muchos de sus elementos (...) esenciales, se pueden rastrear en los escritos árabes medievales clásicos de los orígenes islámicos de Oriente y Occidente, en la mayoría de los casos como dos fábulas distintas. La historia de esta narración se mueve así entre la literatura clásica medieval y la popular premoderna. Incluso toca los márgenes de la historia de las Mil y una noches. En un artículo reciente se ha examinado un manuscrito datado en el siglo XVII que presenta toda la narración tal y como se encuentra con el ritmo y metro del dialect egipcio en el mawwāl. El presente estudio, basado en un manuscrito, analiza en cambio la adaptación de la narrative popular a la prosa. (shrink)

Despite the central place of suffering in medical care, suffering in infants and nonverbal children remains poorly defined. There are epistemic problems in the detection and treatment of suffering in infants and normative problems in determining what is in their best interests. A lack of agreement on definitions of infant suffering leads to misunderstanding, mistrust, and even conflict amongst clinicians and parents. It also allows biases around intensive care and disability to affect medical decision-making on behalf of infants. In this (...) paper, I propose the concept of suffering pluralism, which is a novel multidimensional view of infant suffering based on subjective and objective components. The concept of suffering pluralism is more inclusive of the multiple ways in which infant suffering can occur. It acknowledges and defines a subjective component to infant suffering, while also focusing moral attention on objective well-being by describing it using the language of suffering. This concept allows us to better weigh up subjective and objective components of well-being. It also encourages clarity and consistency in claiming suffering, which is likely to improve communication and reduce conflict in medical decision-making for unwell infants and children. I will end by exploring possible critiques and limitations of this concept. (shrink)

Religious diversity is a key topic in contemporary philosophy of religion. One way religious diversity has been of interest to philosophers is in the epistemological questions it gives rise to. In other words, religious diversity has been seen to pose a challenge for religious belief. In this study four approaches to dealing with this challenge are discussed. These approaches correspond to four well-known philosophers of religion, namely, Richard Swinburne, Alvin Plantinga, William Alston, and John Hick. This paper discusses the "numbers problem," the problem of explaining why you should save more people rather than fewer when forced to choose. Existing non-consequentialist approaches to the problem appeal to fairness to explain why. I argue that this is a mistake and that we can give a more satisfying answer by appealing to requirements of charity or beneficence.

Cognitive scientists distinguish between automatic and controlled mental processes. Automatic processes are either innately involuntary or become automatized through extensive practice. For example, reading words is a purportedly automatic process for proficient readers and the Stroop effect is consequently considered the “gold standard” of automated performance. Although the question of whether it is possible to regain control over an automatic process is mostly unasked, we provide compelling data showing that posthypnotic suggestion reduced and even removed Stroop interference in highly hypnotizable (...) individuals. Drawing on a large sample of highly hypnotizable participants, we examined the effects of suggestion on Stroop performance both with and without a posthypnotic suggestion to perceive the input stream as meaningless symbols. We show that suggestion administered to highly hypnotizable persons significantly reduced Stroop interference and derailed a seemingly automatic process. (shrink)

In 1907, German anthropologist Theodor Mollison invented a unique method for racial differentiation, called ‘deviation curves’. By transforming anthropometric data matrices into graphs, Mollison’s method enabled the simultaneous comparison of a large number of physical attributes of individuals and groups. However, the construction of deviation curves had been highly desultory, and their interpretation had been prone to various visual misjudgements. Despite their methodological shortcomings, deviation curves became very popular among racial anthropologists. This positive reception not only stemmed from the method’s (...) utilities, but was related to additional interests of its protagonists which the method helped promote. Deviation curves provided a unique solution to the holistic–atomistic controversy in German anthropology. By giving separate measurements a consolidated visual form, they substantiated the idea that the attributes of certain social groups were part of distinct racial compounds. Deviation curves thus reinforced racial suppositions, in face of severe criticism on the ontological reality of race itself. Finally, deviation curves emphasized the biological singularity of disadvantaged human groups – Jews, Africans and also women – and of their divergence from ideologically defined physical norms. Disciplinary and social interests thus became intertwined in the formation of a scientific method, which is used to this day in physical anthropology. (shrink)

The acquaintance principle (AP) and the view it expresses have recently been tied to a debate surrounding the possibility of aesthetic testimony, which, plainly put, deals with the question whether aesthetic knowledge can be acquired through testimony—typically aesthetic and non-aesthetic descriptions communicated from person to person. In this context a number of suggestions have been put forward opting for a restricted acceptance of AP. This paper is an attempt to restrict AP even more.

Unjustly forgotten, Laird’s “value and obligation”, I shall argue, is of great relevance to contemporary moral philosophy. To this aim, I will explore three main theses of Laird’s paper which are as follows: (T1) We can’t understand judgments of value and obligation in terms of mere feelings and desires. (T2) Desire must be guided by cognition of some value. (T3) Judgments of rightness and obligation must be grounded in judgments of value.

Rawls developed a contractualist theory of social justice and Scanlon attempted to extend the Rawlsian framework to develop a theory of rightness, or morality more generally. I argue that there are some good reasons to adopt a contractualist theory of social justice, but that it is a mistake to adopt a contractualist theory of rightness. I begin by illustrating the major shared features of Scanlon and Rawls’ theories. I then show that the justification for these features in Rawls’ theory, the (...) centrality of cooperative fairness to social justice, cannot be used to defend their use in Scanlon’s. Finally, I argue that Scanlon has not provided an adequate alternative defense of these features, and show that they create problems when contractualists try to explain major features of our common-sense morality. Contributors to the recent disagreement debate have sought to provide a uniform response to cases in which epistemic peers disagree about the epistemic import of a shared body of evidence, no matter what kind of evidence they are disagreeing about. The varied cases addressed in the literature have included examples of disagreement about restaurant bills, court verdicts, weather forecasting, chess, morality, religious beliefs, and even disagreements about philosophical disagreements. The equal treatment of these varied cases has motivated the search for (...) a uniform response to peer disagreement wherever it is encountered. In this article I challenge this prevalent approach in the literature. I grant the notion of epistemic peer and accept that being a peer may amount to the same thing in different domains; nonetheless I contend that different domains appear to call for different responses to disagreement. I argue that the appropriate response to finding out about a disagreement with a peer is different in different domains. (shrink)
